Maga v The Trustees of the Birmingham Archdiocese of the Roman Catholic Church - vicarious liablity of employers
Roman Catholic Archdiocese of Birmingham is held vicariously liable as employer for sexual abuse of a boy by one of its priests in the 1970's.
This was one of those unfortunate cases in which a Roman Catholic priest, a Fr Clonan, was a predatory sexual abuser of boys. From an employment law angle, the question of interest was whether the Birmingham Archdiocese of the Roman Catholic Church should be vicariously liable for the wrongful actions of the priest. The High Court said not, but this decision has been overruled by the Court of Appeal.
