Kulkarni v Milton Keynes Hospital NHS Foundation Trust - Doctor wins right to legal representation at a disciplinary hearing
Overruling the High Court, the Court of Appeal has unanimously allowed a doctor to have the right to be represented by lawyers at a disciplinary hearing.
In August 2007, shortly after starting work for Milton Keynes Hospital NHS Trust, Dr Kulkarni was accused of improperly touching a patient. The patient had complained that he inappropriately examined her by placing a stethoscope under her knickers without her permission. He was excluded with immediate effect on full pay pending an investigation into the matter.
