Davies & Ors v Secretary of State for Energy and Climate Change - coal miners: extension of time under Limitation Act 1980

In circumstances of case, delay in bringing action meant that judge's refusal to exercise discretion in favour of extending time limits was the correct one.

Eight coal miners, as representative claimants in a group action, sought to bring claims of negligence and breach of statutory duty against the Secretary of State (as successor in title to NCB, the mine operators) in respect of the onset of osteoarthritis in the knees caused during their working lives 1954 - 1993.
