JGE v The English Province of Our Lady of Charity & Anor - employment relationship not essential for vicarious liability

It is not necessary to demonstrate the existence of a contract of employment - or even a relationship "akin to employment" - to establish the vicarious liability of one party (such as a Trustees of a RC Diocese) for the alleged torts of another (eg a priest). All that is required is a sufficiently close connection in the relationship between the parties, and that will be determined on the circumstances of any given case.
