Park Cakes Ltd v Shumba & Ors - right to enhanced redundancy payments via custom and practice

A contractual right to enhanced redundancy payments can arise through custom and practice - it all depends on the relevant circumstances in any individual case

Mr Walter Shumba, Ms Nazleen Amin, Mr Thomas Patterson and Mrs Angela Buckley ('the Claimants') were employed as section managers at a cake and confectionery factory in Oldham. They were engaged separately from 1990 to 2001 by Northern Foods, who through TUPE transfers sold to Vision Group who then sold to Park Cakes. The Claimants were dismissed for redundancy on the 17 July 2009.
