Dismissal of a member of a political party with race discriminatory policies can amount to unlawful race discrimination - that was decided by the EAT in July 2005 when they found that dismissal of bus driver Mr Redfearn, a BNP councillor and election candidate, by SERCO was unlawful race discrimination. SERCO's reason was fear of possible reprisal attacks and they appealed to the Court of Appeal. The Court of Appeal reserved judgment on 30th March 2006.
