Mr Ali is a Somali national who arrived in the UK in December 2002. He claimed to be married to an EC (Dutch) resident and had a son was a Dutch national. The Court of Appeal upholds findings that the alleged wife had never looked for work in the UK and was not a recipient of services in the United Kingdom, since she had never paid for services here. The fact that the son is at primary school in the UK did not affect this.
