A tribunal found a claimant was not entitled to Disability Living Allowance (DLA). The medical member on the tribunal also sometimes acted as an examining medical practitioner (EMP) for the purposes of DLA. As the tribunal had relied, in part, on a report from an EMP for its decision to refuse her claim the applicant appealed, arguing that the medical member's opinions could be biased on that account. The Social Security Commissioners dismissed her appeal.
