Nottingham agency nurse, Sheila Ncube, has won an employment tribunal case against the agency through which her services were provided. The TrustHealthcare nursing agency had refused to give her paid annual leave on the basis that she was not an employee. The tribunal has ruled that she was an employee of the agency (this decision may raise a number of eyebrows given the recent Court of Appeal rulings in Dacas v Brook Street Bureau (UK) Ltd and Cable and Wireless plc v Muscat).
