UNISON sought to quash changes being made to the Local Government Pension Scheme with effect from 1st October 2006. by the Local Government Pension Scheme (Amendment) Regulations 2006 SI 2006/966 [1]. In particular, and not surprisingly, UNISON wanted to retain the "85 year rule" which would be removed by the new regulations (that is the rule under which local government employees could retire on full pension once the sum of their age and their length of service exceeded 85 years). UNISON applied for judicial review.
