The Court of Appeal has upheld the judgment of the Central London County Court in this case in which Mrs Diana Elias, now in her 80's, claimed against the UK government that she was entitled to benefit from an ex gratia compensation scheme set up for those interned by the Japanese during World War II. In essence the British government said she was not British enough to qualify under the scheme but she pointed out that she had been British enough to be interned with the others of her family by the Japanese.
