There was a dispute about pay rates at a particular factory unit run by Anglian Windows Ltd. The GMB Union threatened industrial action. Anglian applied for an injunction to prevent a strike on the basis that the GMB had not conducted a proper ballot as required by Trade Union and Labour Relations (Consolidation) Act 1992 s.226. Anglian argued firstly that each factory unit was a separate workplace and that there should have been (but there were not) separate ballots for each unit.
