A Norwich social security appeal tribunal ruled that a Mr W was not entitled to widow's benefit on the basis that there is an absolute time limit of three months from the death in which claims may be made for widow's benefits - and he was too late. He appealed to the Social Security Commissioner on the basis that he had tried to claim within the time limit, that the DSS had refused to accept his claim and that if his attempt to claim had not been refused he would now have a good claim under European law. His appeal has been dismissed.
