Spanish regulations on granting pharmaceutical licenses do not, subject to the national court ensuring that their application supports the aim being purused, breach the right to Freedom of Establishment as such. However, to the extent that they favour those qualified in Asturias over those qualified elsewhere, they infringe both that right and the requirement to recognise professional qualifications gained in other member states.
