Wilson v HSE - in equal pay claim employer must justify length of service criterion if "serious doubts" are raised

Although theĀ general presumption in equal pay cases is thatĀ length of service is a justifiable criterion for unequal pay, this is no more than a presumption and can be displaced if the claimant raises "serious doubts"; ie shows that there is evidence from which it could be established that there has been a disproportionate adverse impact on women.
