Mrs Hodgson was dismissed by ADM Milling and complained of sex discrimination. She did not put in a grievance and ADM therefore argued that the tribunal did not have jurisdiction to hear her discrimination claim. The Chairman rejected this contention, holding that the grievance was in fact about the fact that she had been dismissed and therefore the situation fell within reg 6(5) of the Employment Act (Dispute Resolution) Regulations 2004 [1] which provides that the statutory grievance procedures do not apply in dismissal cases.
