The EAT ruled in this case that "... where a man and a woman apply for a post [and] they are both on the face of it properly qualified, the post is given to the woman" then in the absence of non-sex related reasons being found the assumption is that there has been sex discrimination (para 5 - but note this may be an over-simplification of what the Court of Appeal said in Igen v Wongand so should perhaps be treated carefully). The case concerned a Sgt Alldred. A female officer had been given a post for which he had applied.
