Where an employment tribunal has found a Claimant to have lied about a central issue to his case, it would nonetheless be a legal error to automatically make a costs order against him: each case must be decided upon its own facts.
Mr Baker was Head of Machine Operations (MO) for Tote. He was based at home due to his health problems, which included MS, but travelled extensively as part of his job. In 2007 a reorganisation of the business resulted in MO being based solely at Tote's Wigan office, from where Mr Baker had to work despite his protestations. He contended that this part of the reorganisation was as a result of his Chief Executive's dislike of employee home working. Mr Baker was made redundant in 2009.
