Mr Davie, who was employed by Wastemaster as a high pressure water cleaner, was dismissed when he was alleged to have been in breach of certain health and safety rules. He successfully claimed that the dismissal was unfair because Wastemaster had not complied with the relevant statutory dismissal procedures. However, the Tribunal also found that even if those procedures had been followed his conduct would, in any event, have led to his dismissal within three weeks.
