Key Points

  • Trade union members (and ex-members) have the statutory right not to be unjustifiably disciplined by their trade union (Trade Union and Labour Relations (Consolidation) Act 1992 (TULRCA), s.64(1)) for certain specified conduct.
  • Such specified conduct includes refusing to take part in a strike or other industrial action, joining another union and working for an employer that employs non-union employees, etc. A trade union member (or ex-member) who has been unjustifiably disciplined can apply to the Employment Tribunal for compensation (TULRCA, s.67 (1)).
