No requirement to provide a workplace free from aerosols
In a similarly reasoned decision, the EAT held in Dyer v London Ambulance NHS Trust that providing an aerosol-free environment was not a reasonable adjustment that the Trust should be expected to take. In this case, Ms Dyer developed a severe allergic reaction to aerosols and after extended sickness absence she was dismissed for capability, the Trust having concluded that there was no reasonable adjustment it could make.
