Mr Staples was dismissed from his role as a director at EA Gibson after a long period of sickness absence due to a heart condition (atrial arrhythmia). After a series of hearings, including one before the EAT in June 2007 [1], he won a disability discrimination claim on the basis that Gibsons had not made reasonable adjustments to accommodate his condition. His claim included a claim relating to sick pay.
Gibsons now appealed to the EAT against the ET's final rulings in early 2008. Gibsons have lost.
