Mr Kennaugh brought a whole host of claims against Cheshire Tree Surgeons at an employment tribunal in Liverpool.
Cheshire Tree Surgeons said he was self-employed and denied all liability. Neither party was represented so the tribunal chairman did his best to help. He concluded that the claims were out of time so that even if Mr Kennaugh had been an employee he had left it too late to bring his claims. Mr Kennaugh's claims were therefore dismissed but nevertheless Cheshire Tree Surgeons agreed to pay him £135 without admitting liability.
