Mr Lawrence, a prison officer, was dismissed due to absences from work caused by eczema. He submitted an ET1 claiming wrongful and unfair dismissal - both on normal grounds and on the basis of disability discrimination - but did not lodge a grievance prior to doing so. The tribunal concluded that, as he had raised the issue of disability discrimination, he should have lodged a grievance before submitting the claim, as required by Employment Act 2002 s.32 [1].
