Mr Lee worked as a Probation Service Court Officer from 1991 until his dismissal in 2007. The Probation Service made a series of changes to the job descriptions and titles of its staff, and Mr Lee resisted such moves. At a disciplinary hearing he was compulsorily transfered to other duties at another office as an Offender Manager. Mr Lee refused to carry out such duties, presenting a grievance. As a result of this refusal, after disciplinary proceedings, he was dismissed for gross misconduct.
