Mauritius Tourism Promotion Authority v Wong Min - the correct approach to the question of state immunity

Other than as provided by the State Immunity Act 1978 [1], a State is immune from the jurisdiction of the UK courts. A State may waive immunity - by expressly doing so, or by taking steps in the proceedings. Furthermore, cases involving the private employment rights of individuals contracted, in the UK, by a commercial agency of a State do not attract immunity (see Sec 4).
