Oni v NHS Leicester City (formerly Leicester City PCT) - criticism in judgment suggesting bias in costs award?

An employment tribunal must explain its decision, and this may include giving the reasons for not accepting a party's evidence or credibility. However, it should stop short of expressing itself in a way that suggests it has also reached conclusions on the matters it would have to decide were an application to be made for costs against that party - to do so, and then proceed to decide the costs application, would create the appearance of bias.
