EAT remits case back to the Leicester employment tribunal to decide which of two possible employers is liable to pay compensation for unfair dismissal. The employing business had changed hands and the basic question was whether there had been a "relevant transfer" so that liability passed to the new owner under the TUPE regulations. The EAT gave guidance as to the considerations the tribunal should take into account (following the case of Cheesman v Brewer Contracts [2001] IRLR 144, EAT)
