Renfrewshire Council rejected a job application by one of its councillors, a Mr Martin, aged 63. His application for a post as a pupil support worker was turned down. He was told that he was rejected on grounds of competence. He believed the real reason was his age so he brought a claim under the 2006 Age Discrimination Regulations [1]. An employment tribunal chairman ruled that he had an arguable case. The Council appealed.
