Right to Not be Denied Access to a Court

Key Points

  • A member or former member of a trade union may bring court proceedings against the union if they have already made a valid request to the union for the consideration of the issue at least six months before commencing court proceedings.
  • Any attempt by a trade union to exclude the jurisdiction of any court will have no effect (section 63(1) Trade Union and Labour Relations (Consolidation) Act 1992 (“TULRCA”)).
