When using the Employment Judges' "Pension Rights guideline" [1] to assess pension loss following a finding of unfair dismissal if the employee has a long period of service and has reached an age where they are less likely to be looking for a new job a Tribunal should generally use the 'substantial' approach (as opposed to the 'simplified' approach) set out in those guidelines.
Mrs Sibbit worked as a teacher at a Wigan school from 1985 to 2008 when she was dismissed. She would have reached retirement age in 2009. Her pension was based on receiving one eightieth of her salary for each year of pensionable service.
