An unqualified teacher who suffered from a dislocated shoulder problem (which was agreed to be a disability within the meaning of DDA 1995) lost a claim of unlawful disability discrimination. He was dismissed because he failed to fulfil a condition of his original offer of employment, that he must be qualified by end May 2004.
He lost a claim that failure to extend the deadline was a failure to make a reasonable adjustment as required by DDA 1995.
