Mr Towu lost a sex discrimination claim against the trust. He had been shortlisted for a job as a paediatric surgeon but the job went to a Mrs Kufeji. The trust was awarded £10K costs on the basis that his claim had had no reasonable prospects of success and that he acted vexatiously and unreasonably in raising new allegations at the hearing.
He appealed against the costs order. EAT decided that there had been no error of law in making the costs order and dismissed the appeal.
