Mr Venniri was dismissed by Autodex for gross misconduct. An employment tribunal found his dismissal fair without considering whether or not the statutory dismissal procedures had been followed. Mr Venniri appealed.
The EAT allowed his appeal. The tribunal had erred by not considering whether the statutory dismissal procedures were relevant. The EAT took it on itself to consider this point and found that the statutory dismissal procedures had not been followed. Mr Venniri's dismissal was therefore automatically unfair.
